Adobe To Post Photoshop CS3 Beta

Adobe will be opening the Photoshop CS3 beta to owners that currently have 2.0. On the Mac side of things, universal binary support is here. Hopefully more companies will begin to really port their apps over to Apple software.

The final version of Photoshop CS3 is due in spring 2007, according to Adobe. Adobe will make the beta available as a universal binary--meaning it will run on both PowerPC- and Intel-based Macs--for the Macintosh, as well as for Microsoft Windows XP and Windows Vista. The release will include an early version of an upgrade to Adobe Bridge, an application for managing files. The beta will also include a new tool, Adobe Device Central, for creating content for mobile devices.

Evilness Of Google

Google has turned so evil that they are now patenting their WEBSITE USER INTERFACE! The fairytale is over and Google is evil. How can you patent a look and feel anymore? I thought there were court cases against this. I guess this shows the blatant stupidity of the USPTO.

Distinguishing between the look and the function of an invention isn't always easy. But imagine that you're seeking a patent for a wine glass. If it's simply a combination of glass stem and bowl that has been done many times before, it would not be eligible for a patent. But if there is some sort of unique, fanciful etching on the glass, then it could theoretically be patented if that design feature is "inseparable from the article to which it is applied and cannot exist alone." The question of what makes a patent too obvious to merit protection, which the U.S. Supreme Court is currently mulling, applies to design patents as well as utility patents. The distinction with design patents is perhaps even more fuzzy, said Philip Mann, a Seattle-based patent attorney and author of the IP Litigation Blog.

Intel Viiv Still A No Show

What is Viiv? Intel's failure of a platform. Viiv doesn't work because people sometimes LIKE to have a device do one thing that it is good at. A computer should not replace a TV. Ohh, and that Intel cannot pull a Centrino style platform on the desktop with the same ease.

DIY Windows Service Pack

A security company has released a tool to allow you to make a 'service pack' for Windows that can be installed offline. Since Microsoft does not step up to the plate with these types of tools, it is good to see others making them. I guess Microsoft is too busy locking down Vista with DRM to screw customers out of stuff they paid for.

Microsoft May Increase Ad Budget For Zune

While Microsoft thinks about trying to sell these Zune music players, Apple is cleaning up the market with its iPod brand. Microsoft needs to get it in gear to sell their music players. The problem: They are a failure.

To woo that set, Microsoft has been pitching the Zune in TV spots, outdoor ads, print ads and online promos, mainly trying to get into the heads of those aged 18 to 28. But even with a decent size marketing budget, Microsoft knows it may need to buy more ads to try to get the Zune better known. The company's initial goal was to have its ads reach about one quarter of those in its target age range, and reach them at least three times. It has TV ads that have run in shows like Prison Break, Family Guy and Grey's Anatomy, and has inserted print ads in magazines such as Scratch, Paste, Spin, Vibe and Rolling Stone. There are also online ads on sites like AOL, Billboard and MTV, as well as on Microsoft's own MSN site.

iTunes Sales Falling

Looks like most people finally have what they need in their media collections. What I don't understand is how media cartel's expect people to pay more than once for people that purchase their music. Ohh yeah, DRM!

The leading DRM digital download service, Apple's iTunes, has experienced a collapse in sales revenues this year according to analyst company Forrester Research. Secretive Apple doesn't break out revenues from iTunes, but Forrester conducted an analysis of credit card transactions over a 27-month period. And this year's numbers aren't good. While the iTunes service saw healthy growth for much of the period, since January the monthly revenue has fallen by 65 per cent, with the average transaction size falling 17 per cent. The previous spring's rebound wasn't repeated this year. And it isn't just Apple's problem. Nielsen Soundscan has grimmer news for prospective digital download services, indicating three consecutive quarters of flat or declining revenues for the sector as a whole.

Microsoft Drops VBA Support In Mac Office 2K7

In a move that looks to make Mac users purchase a new Windows license, Microsoft is not putting in VBA support in Mac Office 2K7.

Here’s the background. Back in August, Microsoft’s Mac Business Unit updated Mac users on the status of its development efforts for the next version of Office. According to the software giant, things were going well, and we learned that there will be free XML converters for current Office users to read the new Office for Windows' file formats. (However, we've since learned that there will be a three to four month gap between the release of Office for Windows and the availability of the Mac converters. Those could be a few painful months to be a Mac Office user in a Windows environment.) The MacBU also noted that tens of millions of lines of code had been successfully transitioned to Xcode. Microsoft also indicates that it is discontinuing support of Visual Basic (VB) scripting in the next version of Office for Mac, but on the flip side, the company said it's going to increase support for standard Mac scripting methods like AppleScript and Automator.

Java On Itself

BEA Systems created a version of Java that runs directly on VMWare's hypervisor. This brings virtualization into the mainstream for Java.

In BEA's case, it created software called Liquid VM. Liquid VM is an addition to the company's JRockit Java virtual machine, which runs directly on VMware's hypervisor. That virtual machine allows Java programs to interact with hardware servers without the need for an operating system, according to Stephen Hess, director of product management for the WebLogic Platform.

Cell Phones Don't Cause Cancer

Yet another study has shown that cell phones do not cause cancer. I believe we should just assume that anything we do in the world causes health problems and move on. I can't eat this, live to close to that, wear this thing...

A huge study from Denmark offers the latest reassurance that cell phones don't trigger cancer. Scientists tracked 420,000 Danish cell phone users, including 52,000 who had gabbed on the gadgets for 10 years or more, and some who started using them 21 years ago. They matched phone records to the famed Danish Cancer Registry that records every citizen who gets the disease and reported Tuesday that cell-phone callers are no more likely than anyone else to suffer a range of cancer types. The study, published in the Journal of the National Cancer Institute, is the largest yet to find no bad news about the safety of cell phones and the radiofrequency energy they emit.

UK Report Wants Stronger IP Laws

Why do governments waste their time on these meaningless issues? IP laws are way to strict and are given too much time for the IP holder for a monopoly of their garbage. I support a small time monopoly for copyrights. Remember that the value is NOT the copyrighted material but the government mandated monopoly granted. Once people realize this, the actual content is worthless to anyone except society as a whole as it should be.

The Gowers Report was commissioned by the government to look at modernising UK copyright laws for the digital age. While it proposes new powers against copyright infringement, it also says private users should be allowed to copy music from a CD to their MP3 player. It also recommends the 50-year copyright protection for recorded music should not be extended. Former newspaper editor Andrew Gowers said piracy and counterfeiting was probably the biggest challenge the intellectual property (IP) system faced.

Microsoft Tries For ECMA Open XML Standard

ECMA Int will likely vote to approve Open XML as a standard on Thursday. Open XML is redundant due to OpenDoc being an ISO approved standard. While it is nice that Microsoft finally has an open standard, it is too little too late.

Microsoft Office Open XML is the default document format for its Office 2007 suite, which was recently released to businesses and is set for consumer availability on January 30. Another Zero-Day Alert For MS Word

This flaw extends back all the way to MS Word 2000. There is no patch yet which is why this is a Zero Day security risk.

A security advisory from the Redmond, Wash., company said the flaw can be exploited if a user simply opens a rigged Word document. Affected software versions include Microsoft Word 2000, Microsoft Word 2002, Microsoft Office Word 2003, Microsoft Word Viewer 2003, Microsoft Word 2004 for Mac and Microsoft Word 2004 v. X for Mac. The Microsoft Works 2004, 2005 and 2006 suites are also affected because they include Microsoft Word.

AMD Moves To 65nm

AMD has finally made the move to 65nm. Chips using the shrinked technology will appear soon. Expect a new wave of really good overclockers with this. Intel has been on 65nm for some time. The Core 2 Duos are awesome.

Intel first began shipping 65-nanometer chips in October 2005. (The nanometer figure refers to the average size of features on the chip; a nanometer is a billionth of a meter.)

NASA Plans Moonbase By 2024

NASA has finally released the strategy for a real base on the moon. 2024 is the target date.

The base would be built in incremental steps, starting with four-person crews making several seven-day visits. The first mission would begin by 2020, with the base growing over time, beefed up with more power, mobility rovers and living quarters. The Moon base would eventually support 180-day lunar stays, a stretch of time seen as the best avenue to establish a permanent presence there, as well as prepare for future human exploration of Mars.

Microsoft's Bullying Tactics in MA

Reading this article just makes Microsoft look like the steaming pile that they are. Microsoft tried so hard to influence the MA government to stop ODF from becoming the standard. Microsoft refuses to play with the community and instead forces people to submit to them.

Vista Cracks May Be Malware

Be careful if you are searching for Vista cracks to strip activation off the product that you purchased. Some people are putting out trojans instead of a helpful crack. Jerks.

Malware makers are starting to take advantage of the number of users searching for cracks for the pirated copies of Vista floating around. A new download has started circulating around the crack boards called "Windows Vista All Versions Activation 21.11.06". It purports to be an activation crack for any version of Vista. However, the file is actually a trojan-carrier which will install Trojan-PSW.Win32.LdPinch.aze onto your PC. BitTorrent users who posted reviews of the crack said that a number of antivirus programs detected the malware, though Norton AntiVirus and NOD32 did not.

OpenDocument Now ISO Standard

OpenDocument is now a real standard. ISO/IEC 26300:2006.

Boycott Universal Music - iPod Tax

NEW YORK (Reuters) - Universal Music Group Chief Executive Doug Morris said on Tuesday he may try to fashion an iPod royalty fee with Apple Computer Inc. in the next round of negotiations in early 2007.

Universal, the world's largest music company, owned by French media giant Vivendi, was the first major record label to strike an agreement with Microsoft Corp. to receive a fee for every Zune digital media player sold.

"It would be a nice idea. We have a negotiation coming up not too far. I don't see why we wouldn't do that... but maybe not in the same way," he told the Reuters Media Summit, when asked if Universal would negotiate a royalty fee for the iPod that would be similar to Microsoft's Zune.

"The Zune (deal) was an amazingly interesting exercise, to end up with a piece of technology," he added.


Vivendi is a French company! Those asshats. There was a quote I saw before that is not in this article from the head of Universal Music... "These devices are just repositories for stolen music, and they all know it. So it's time to get paid for it." I'm sorry bud, most people don't pirate music anymore. It isn't worth their TIME to do it. Calling all your customers criminals is also a good way to alienate your base. I'm telling everyone to boycott all of Vivendi Universal's garbage. They screwed me on games and now they are screwing you on music.

Child Porn: Kids With Full Clothing On

MPAA Sues Over Ripping DVDs

The MPAA has finally brought a lawsuit against a company that I hope goes to court. With this, the MPAA has said that ripping DVDs (that the company sells and places on iPods for customers, so the customer owns both), violates the DMCA and is illegal. The sad part is, this is totally true since the DMCA says that it is illegal to break encryption. The good thing is that fair use says a format shift is perfectly legal. With a case like this going to court, perhaps a court will have the smarts to do the right thing and invalidate that portion of the DMCA that disallows the fair use of content.

A buyer could be subject to legal liability for ripping purchased DVDs at home onto a purchased portable video player without either first seeking permission or purchasing the content again for specific use on the portable video player. One wonders whether a court would embrace such an argument. Load 'N Go Video likely will assert that it has engaged in "fair use" for copyright purposes, and that such fair use trumps the claims of the motion picture studios under the Copyright Act and the Digital Millennium Copyright Act. While Load 'N Go Video under these facts does have a defense to assert, one must keep in mind that the motion picture studios, like the music industry, have been very successful to date in seeking to protect their copyright works. Corel Office To Support ODF And MS Office

A word processor is basically the same. Not matter what program you use, as long as it uses ODF, you are fine. Corel is taking the step and support ODF as well as MS Office document formats. Corel may get a leg up due to ODF's push.

Supreme Court To Consider Climate Change Legislation

I love how the Supreme Court is deciding things that should be done by Congress. Can the EPA select not to enforce emissions?

No, you can't just coin a term and expect people to follow it. Black Friday is called that for a reason. It used to be the day that stores would go into the black on their balance sheets. Making sales for that day is just icing on the cake.

Illinois Bans Free Speech

In August 2005, the Illinois State Legislature enacted the Sexually Explicit Video Game Law ("SEVGL"), which criminalized the sale of "sexually explicit" video games to minors, and required purveyors of such games to conspicuously label any sexually explicit game with a four square inch label reading "18", and provide relevant signage within the stores where games are sold. The Entertainment Software Association, among others, filed suit against the State of Illinois the day after the SEVGL was enacted, claiming that the law violated the First Amendment. The district court permanently enjoined enforcement of the law, and the State of Illinois sought review. On appeal, the Seventh Circuit affirmed the lower court's holding that the statue was not narrowly tailored.

UK Votes To Keep Copyrights At 50 Years

Another sane ruling by the people of the UK. The government has decided to not extend the copyright monopoly to 95 years. In the US, we have a much longer copyright term which is terrible. How does this entice artists? Copyrights should be merged with patents and should only last a minimum amount of time.

Solution: Get off your ass and get a job. Making something in 1955 does not entitle you to extort money from people for the rest of your life.

Supreme Court To Decide Obviousness Level Of Patents

We shall see if the Supreme Court will actually make the obvious level of patents higher. There are tons of patents that are so obvious when they were filed, it is terrible. The patent system needs to be reworked...

Virtualization Not "Mature" Enough For Home

Microsoft is denying use of its Vista Home products for virtual machine use. They cite "risks" that are basically BS. It is just another attempt of extorting money from people.

According to Microsoft's Windows Vista End User License Agreement (EULA), the platform's Home Basic and Home Premium editions cannot be run as a virtual machine (VM). Such restrictions do not apply to the business versions of the OS. "Today, customers using this technology are primarily business customers addressing application compatibility needs or technology enthusiasts," the spokesperson said. "For everyday use, Windows Vista Home and Home Premium cannot be installed in any virtual machine technology, but Business and Ultimate versions can. Each virtual installation of Windows requires a new license just as it was for Windows XP."
